Coleta de provas na investigação de crimes cometidos na área esportiva: regras internacional e europeu

O esporte desempenha um papel importante na sociedade moderna. A sua regulamentação jurídica é complicada pelas peculiaridades da estrutura da modalidade, dos seus participantes, dos tipos de invasões ilegais e das medidas de influência para as eliminar. Atualmente, diversas relações jurídicas estão sendo invadidas no âmbito esportivo: desde o âmbito dos e-sports até a corrupção e o doping durante as competições esportivas. Perante isto, importa analisar a regulamentação jurídica internacional relativa à investigação de crimes no domínio do desporto e compreender os problemas da prova deste tipo de crimes e da implementação das normas internacionais na regulação nacional. O objeto do trabalho é a investigação da delinquência no domínio do desporto do ponto de vista da sua evidência, bem como a análise das normas internacionais e europeias nesta matéria. O objeto de estudo são as normas internacionais e europeias para a obtenção de provas na investigação de crimes cometidos no domínio do desporto. O objeto de estudo são as relações sociais que surgem, mudam e cessam e influenciam o estabelecimento de normas para a investigação de crimes nas diversas fases da investigação preliminar de crimes no domínio do desporto. A metodologia de pesquisa é composta por métodos como: dialético, metafísico, sistêmico, sinérgico, antropológico, lógico, histórico, sistêmico-estrutural, estrutural-funcional, formal-jurídico e comparativo-jurídico. Como resultado da pesquisa realizada, foi possível compreender as peculiaridades da regulação jurídica internacional da atividade criminosa no âmbito esportivo. Especial atenção é dada às peculiaridades da prova dos crimes cometidos na área esportiva. Da mesma forma, é dada atenção à experiência de criação, formação e aplicação de medidas internacionais de combate ao crime no domínio do desporto e do direito desportivo, à sua implementação nos sistemas jurídicos nacionais e às questões problemáticas no contexto apropriado.
