Tipos de crimes de corrupção no desporto nos países da União Europeia

Resumo

Os crimes de corrupção no desporto há muito que ultrapassaram a escala nacional e tornaram-se um problema global. O objetivo desta investigação foi estudar os tipos mais comuns de crimes de corrupção na UE e fornecer recomendações sobre regulamentação legislativa para combater a corrupção desportiva na UE. Os seguintes métodos foram utilizados neste estudo: método de comparação e contraste; o método de análise descritiva; o método anamnésico; o método de previsão. O estudo estabeleceu que as principais formas de crimes de corrupção no desporto são o suborno ou a fraude. Os tipos mais comuns são manipulação de resultados (33 casos), doping (24 casos), fraude (6 casos), legalização (lavagem) de produtos criminais (4 casos). A corrupção tem as seguintes influências no desporto: descrédito dos atletas; ameaça à saúde do atleta; declínio na popularidade e difusão dos esportes; diminuição da confiança dos fãs; uma ameaça para todo o sector desportivo. Conclusões. É aconselhável adoptar a Convenção da UE sobre o Combate à Corrupção e ao Suborno no Desporto, que consagrará uma lista dos principais tipos de crimes de corrupção no desporto, as principais ameaças dos crimes de corrupção no desporto, as orientações da política estatal no domínio sob investigação . tipos de responsabilidade por essas ações; As obrigações do Estado-Membro da UE no que diz respeito a este ato jurídico regulamentar devem fazer com que a legislação nacional o cumpra. Este estudo não é exaustivo e a proposta de desenvolvimento da Convenção de Combate à Corrupção e ao Suborno no Desporto abre perspectivas para futuras pesquisas no domínio da regulação e gestão no desporto.
