Abstract

This contribution is focused on two recent decisions of Spanish Constitutional Court that deal with the matter of access to justice when the public administration does not conclude the administrative procedure expressly (SSTC 14/2006, 16th January, and 39/2006, 13th February). In those cases, a provision on access to justice establishes a timeframe of six months, from the date in which the answer must be given, to formulate a judicial appeal against the tacit administrative decision (Article 46(1) of Ley de la Jurisdicción Contencioso- Administrativa de 1998). According to STC 14/2006 that timeframe will not be applicable until the public administration does not fulfil its obligation to communicate the date in which the administrative procedure must be concluded and the effects of a negative silent. This obligation is established in Article 42(4)(2) of the Public Administrative Act (Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y Procedimiento Administrativo Común), modified by Ley 4/1999, 13th January.
