Abstract

This paper analyzes, beginning with a general presentation of Canadian public healthcare system, the echoes of 2005 Supreme Court statement in Chaoulli v. Québec, considered to be the most important judgment regarding sanitary rights in Canada in recent times. This case illustrates the advance of private sector in health affairs, proving that private practice is called to affect public sanitary services quality and patients’ rights; that is the reason why a compared study is hereby proposed.
