Abstract

The paper analyses the current legal regime regarding the duty to preserve the buildings
foreseen in the State planning regulations. Three types of preservation are defined and their
regimes and limits are analyzed, with special attention to the regime applicable to listed buildings.
In order to properly understand the duty of preservation, it is essential to understand the social
function that defines the content of the property right and substantiate the owner’s legal duty to
preserve the buildings and the obligation to face the financial burdens that may arise from this duty.
