The Law for the Promotion of Territorial Sustainability in Andalusia and the treatment of irregular buildings on rural land: a solution to the problem or the perpetuation of a historical failure?

The solution to the territorial pathology caused by the development of irregular buildings on rural land —mainly residential— continues to be one of the pending accounts of Andalusian town planning. Since the enactment of the Andalusian Urban Development Law, different legal initiatives have been implemented with the aim of typifying this problem in order, in the first instance, to eradicate it or, if this proves impossible, to promote its recognition and regularisation. However, after more than two decades, the results obtained reveal a worrying lack of effectiveness. It is in this context that the Law for the Promotion of Territorial Sustainability in Andalusia and its General Regulations were enacted. The aim of this article is to analyse the scope of this new regulatory framework to promote the recognition of illegal plots — clusters of irregular buildings, according to the terminology of the new legal framework —, to make hypotheses about its application and to draw conclusions as to whether the measures adopted can be effective in solving this problem or, on the contrary, will not succeed in preventing the institutional failure that has characterised previous regulatory initiatives from being perpetuated.
