Abstract

Legal certainty is a pre-requisite for the rule of law. The article analyses certain ideas that may contribute to the enforcement of this principle and warns that its relativisation may trigger a shift towards totalitarianism, in that —very often— dictatorial regimes use the concept of certainty as their ratio essendi.
