Abstract

This paper examines, in the light of Constitutional Court Judgment 26/2024 of 14 February, parents’ disagreements over their children’s religious education, specifically in the choice of school, and their resolution by the Courts of Justice. A critical analysis will be made of the line of interpretation set by the Constitutional Court in the weighing up of rights and the application of the interests of minors. The interest of the minor which the Court focuses on the protection of the “right to religious self-determination” of the minor who does not yet have the capacity to exercise her right on her own and which can only be guaranteed in a public educational centre, as it is a religiously neutral educational environment.
