Abstract

So far the Spanish Central State Administration Authorities would be the only liable against the relevant European Institutions in case of non compliance with the European legal obligations, even whether the State has not the full capacity to avoid the non-fulfillment. After analyzing the different solutions provided by other European countries to this common issue, it is also examined the Spanish solution: (i) the Organic Law 2/2012 on Budgetary Stability and Financial Sustainability of the Public Administrations, which regulates the general principle of individual liability of each competent Authority and give a mandate to develop a general procedure; and (ii) the Spanish Royal Decree 515/2013 of July 5, which establishes the criteria and procedure for determining the State liability and its capacity of recourse to the different National Public Administrations because of non compliance of any European legal obligations. Finally, the conclusions.
