Abstract

Traditionally the concern on the quality of regulation has focused on formal or technical issues, nowadays the concern on the substantive content of legal rules and their efficiency is increasingly relevant. The material dimension of regulatory quality refers to the effectiveness of legal rules’ impact on their target reality and uses as its main tools Regulatory Impact Assessments (RIAs). Currently the impulse for the use of RIAs is framed in the administrative simplification and better regulation programs. This article examines RIAs as useful tools to achieve better quality of regulation, describing the difficulties found for their use and implementation in Spain. Against that background it is telling to find an isolated case of the preparation of a previous RIA on the Building Technical Code in 2005.
