Abstract

The first section of this paper identifies serious failures in Spanish Water Law regarding privately-owned waters. In the second and third section of the work, the amendments introduced by Act 11/2012 and Decree 670/2013 are discussed, trying to make the point that both reforms are directed not only against the traditional concept of private ownership but also against Article 17 of the Charter of Fundamental Rights of the European Union, proclaimed in Nice in 2000, which is clearly based on this traditional concept and has binding character upon Spanish Law. The fourth and the fifth sections issue critical comments concerning the amount of fines to be paid and the assessment of the damage introduced by the aforementioned Act 11/2012 and Decree 670/2013.
