Abstract

The absence of legal regulation about the wind element, the indefinition of its legal nature and its null economic value have led to an unsatisfactory approach to the valuation of the land for wind use. Rural land has undergone an important evolution in the last times. The installation of industrial facilities of general interest requires an appropriate approach about its new social role and its economic value. The implementation of wind farms needs land with enough wind available as to guarantee its profitability. The special wind suitability of the land and the reservation in the Wind Plan of specific land areas for exploitation deserve some thought when defining the range of the expropiation appraisal, when expropiation is the procedure adopted to obtain that land.
