Abstract

The prohibition of reformatio in peius is a procedural principle that the Spanish administrative law applies to the resolution of administrative appeals and other administrative procedures requested. Its ultimate justification can be found mainly in the protection of the appellants. The jurisprudence has determined the extent of such prohibition and possible exceptions. According to this, we analyze the legitimacy of some cases of reformatio in peius in Spanish administrative law.
