Abstract

Present work deals with the legal regime applicable to those cases in which
the successful bidders, after concurrently bidding for an administrative concession,
constitute new interposed companies, or instrumental character ones, with which
they intend to contain their eventual liability in the fulfillment of the contractual
conditions. It is about establishing in these particular cases, who is the legitimate
concessionaire or contractor; what is the legal regime applicable which the public
procurement contractors are subjected to and, particularly, what happens in the event
of insolvency or winding-up of these instrumental companies, which are specifically
created for managing the Public Concession.
