Abstract

The new Public Procurement Law promotes the use of environmental clauses in public procurement. In this sense, the introduction of life-cycle costs as an economic-environmental criterion for the award of contracts should be highlighted, as well as the control of the environmental legality of the contractor’s activity by the contracting authority. It may be said that, in matters of public procurement, the merely “buyer” State is being transformed into a “regulator” State.
