Abstract

Competition law has turned into one of the fields of reference within Public law, due to the difficulty of reconciling the sanctioning powers with the open economic terminology, the impact of European competition law on the traditional separation of powers and the implementation of new tools from the U.S. such as the leniency program or the block exemptions. Aside from the analysis of Antitrust law, this paper criticizes the Law on Market Unity and its interpretation of the freedom of enterprise and freedom of competition as values preceding other constitutional rights and goals.
