Abstract

The aim of this article is to study the international and national laws that provide some protection to the underwater cultural heritage. The legal analysis demonstrates that there is no legal specific protection over the underwater archaeology. Due to this lack of regulation, we can appreciate some type of legal allowance that has as immediate consequence the damage and destruction of cultural heritage objects. Odyssey’s case is a recent demonstration of an unsatisfactory legal protection of the underwater cultural heritage. Therefore, we are giving some legal advice in order to find a solution for this matter.
