Abstract

This article analyses the new legal system governing performance commissions between Public Administrations and their instrumental bodies, opening up new opportunities to commission works, goods or services beyond the standard regulations for public tenders. This framework was provided for under the Royal Decree-Law 5/2005, of March 11th, that added a new section l) to article 3.1 of the TRLCAP, which excludes from its intended scope any such «management commissions made to the bodies and companies whose capital belongs entirely to the Public Administration itself». The reform is analysed within the framework of Community doctrine relevant to «in house providing» contracts, bestowing legal systemisation to its consequences and opportunities for administrative management.
