Abstract

The new Spanish State Radio and Television Act intends to solve a controversial issue, wide discussed, both socially and politically, that is has been an object of a wide political and social debate: the public funding of these two state-owned media and the extent to which this is compatible with Competition Law. This article offers an overwiew to the approaches to this question taken by both European and Spanish Institutions. Our country has carried out several attempts to adapt the Spanish Law to the EU directives. Furthermore, the article analyzes whether the model of funding set up by the new Act of 2006 is in compliance with the EU Competion Law.
