Abstract

This study turns the party of the second part of the great process of decentralization that is developing in the Spanish Status from the Constitution of 1978 astride. If the first phase of devolution developed, basically, the regional environment, the second have for purpose to increase the autonomy of the municipalities empowering its competences with drawdown of the functions of the Status and the regional communities. In the same line the controlling interests are disapproven of these on the municipalities. He comes off this way of the proposals contained in the White book and in the Bill of the Local government that this radical conception of the local government tries to legalize in a municipal supposed sovereignty. The study is framed inside a historical context and of comparative law.
