Abstract

The purpose of this article is to examine the system of administrative statuses of civil servants envisaged by the state legislature. The Basic Statute of the Public Employee has introduced significant changes in this area. The new regulation allows important flexibility and freedom for the autonomous legislature, which represents a major departure from the previous situation. The author reflects on the new framework for action permitted by the basic state legislature, which leaves freedom for all those situations directly related to the administrative organization. At the same time, she compares the proposals made by the Expert Committee on this issue with the outcome reflected in the final text of the law. However, in certain respects, the legislature has ignored those recommendations, which may pose interesting problems, especially when the employee serves temporarily in a political post outside his institution (secondment). In any case, this study allows us to reflect on the changes, challenges and opportunities for reform that involves the new conception of the basic state regulations on this matter.
