Abstract

This paper looks into the multifaceted nature of an ambiguous legal label, relationship of special subjection, which, although paid special attention to by Administrative Law scholars in the 90s, has been reduced to almost complete oblivion. Some academics point to its being in low regard; others claim it is dispensable. There are those who even advocate its abandonment. In the light of all this, this paper aims at contributing to streamline the legal term, one which might play an essential role in today's legal domain as the Constitutional Court has taken an ecleptic, inconsistent at times, course which does a disfavour to itself. Specifically, we look into the legal constraints of retribution and disciplinary action within the domain of such relationships.
