Abstract

This essay analyse both sides of Administrative Law, as a rule and as a theory. Even though it is focused on the Italian case, the argumentation is relevant for administrative law in general. In the first side, we would have an administrative law from all society, based on rules nor all of them coming from, the Parliament and with two main types of rules, those authoritarian and those conventional. In the second side, there is an initial reference to the romanistic tradition, german culture, and the role of great professors. There is also room for the crisis of the unity of Public Law and the problems of institutional instability and the systemic provisionally.
