Abstract

In the local political system can distinguish two fundamental elements: the relationship between the local power and relations between citizens and local government bodies that shape the orm of local government. This paper deals with the study of one of the aspects that have led to the «parliamentarisation» of the form of local government, the introduction of mechanisms of political accountability requirement own rationalized parliamentarism such the confidence motions in the Municipal. We analyze the requirements, guarantees, limits and effects of confidence and the motion of censorship into the Mayor, on the occasion of the 2011 reform of the «Ley Orgánica de Régimen Electoral», particularly the impact that reform has had on the right councilors to access to a representative public office. The paper also discusses the recent judgment of the Constitutional Court, the «STC 81/2012» of 18 April, in which the Court hearing a constitutional question on the art. 110.1.g) of the «Ley Municipal y de Régimen Local de Cataluña», and fixed case law on the delimitation of powers regarding the regulation confidence motions in the Municipal.
