Abstract

Scientific freedom [section 20.1.b) of the Spanish Constitution] implies, on the one hand, a subjective fundamental right allowing the researcher to avoid interferences or intrusions in his scientific activity and, on the other hand, an objective dimension imposing the State the duty to make possible and to  regulate the development of scientific research by creating such  organizational and procedural structures that science may be autonomously  ruled by its own patterns. In this regard, the legal status of those institutions in which scientific public organization is undertaken, such as Royal Academies, has to be shaped according to the constitutional requirements  imposed by the objective dimension of scientific freedom, i. e. as regulating organizational principle.
