Abstract

This article seeks to fill the doctrinal void surrounding the balanced participation of women in the judiciary, in order to study the horizontal functional segregation in the various jurisdictions and the glass ceiling in the higher hierarchies of the judiciary, from a constitutionalist perspective and a gender perspective. Throughout its pages, it will analyse legislation and jurisprudence regarding the discretionary appointments of the CGPJ and the inclusion of affirmative action measures or balanced participation of women and men in accordance with Spanish Act No. 3/2007 and the scope and study of conciliation policies in the judiciary. Finally, reform proposals will be put forward to guarantee substantive equality in internal promotion within the judiciary and to introduce the principle of parity democracy as a means of re-legitimizing the judicial system.
