Abstract

This essay has the aim to study the origins, development and obstacles faced by the configuration of sexual harassment as a sexually discriminatory phenomenon in the United States of America. With this purpose we will study Antidomination principle which played a crucial role in said conceptualization, analizing the main objections formulated against that theorization. Then we will explore the process through which US courts have advanced towards the recognition of sexual harassment as a sex-based discrimination practice, highlighting the main obstacles faced in its development. Finally, we will analyze the main modifications that the #MeToo movement has brought about in the treatment of sexual harassment in the aforementioned country.
