Disposal Of Public And Military Property And Urban Regeneration In Italy: Inertia And Issues Still Pending

Jurisprudence regarding the disposal of public property assets in Italy began in the mid-
1980s and continued into the 1990s, in a situation of chronic financial problems affecting the Italian
state. Also, on a national scale, military assets were often found no longer to address the current
needs of the armed forces, not only because they lay in marginal areas in the new international
logistical and strategic framework, but also because they were obsolete for any modern defence
system (or would require considerable resources to adapt them to the latest technology, legislation
and standards).
The aim of this paper is to present a brief reconstruction of the history of the reuse of public property
assets in Italy, describing the heterogeneous, complex legislative framework that underlies the
asset-regeneration process, particularly for old military facilities. The paper proposes a
reconstruction of the inertia that has characterised the programmes developed by the Italian state,
associated procedures and urban-regeneration processes.
