Abstract

This article intends to express that an excessively wide judicial function disregards the role of the Legislative Power in creating law. It also impacts in the exercise of administrative decision making, to the extent that this phenomena leads to the deflation of the Public Administration and of the Legislative as a space of political debate. Moreover, something crucial for the correct development of administrative activity, law and society is lost: predictability. Therefore, the Administrative authorities do not have security to take decisions nor does the population see the administrative acts as authoritative.
