Abstract

This article analyses horizontal and vertical interconnection between laws, jurisprudence and doctrine, with special reference to international and European examples. After examining the general use of comparative references by the legislature and the judicature, it focuses on the role of such citations at a level over and above the state. It specifically deals with the role of doctrine and its contribution to the construction of laws, jurisprudence and the drafting of treaties (and their interpretation) including analysis of significant cases (United Kingdom and Eastern Europe).
