Rights in rem and property consequences in Family Matters: delimitation in and among the EU Private International Law Regulations

Abstract

EU Private International Law system is an incomplete system in terms of Rights in Rem. Moreover, that affects when Rights in Rem are involved in to other specific Regulations in Family Matters, as Regulations (EU) 2016/1103 and 2016/1104. The aim of this article deals with, the analysis Case Law of the CJEU in relation to the delimitation in and among instruments of EU Private International Law and its material scope, especially from a coherence approach and its different modalities.

En el contexto de un sistema de Derecho internacional privado de la UE incompleto en materia de derechos reales que entra en relación con regulaciones específicas en materia de familia, como sucede con los Reglamentos (UE) 2016/1103 y 2016/1104, el presente artículo se ocupa, del análisis del recorrido de la jurisprudencia del TJUE en relación con la delimitación en y entre instrumentos del Derecho internacional privado de la UE y su ámbito de aplicación material, especialmente desde un enfoque de coherencia y de sus distintas modalidades.
