Análisis de impacto normativo y control judicial de la discrecionalidad reglamentaria

Abstract

This article analyzes recent progress on regulatory impact assessment and justification of administrative regulations in Spanish Law. It focuses on the consequences on judicial review, considering United States and European  Union Courts case law. It is argued that these assessments not only can  contribute to improve the decision-making process, but also to facilitate  substantive review of these regulations, affecting to the burden of proof.
