Abstract

The purpose of this paper is to analyze the issue of substitute compensation in
the event of the impossibility of enforcing a judgment on its own terms, determining the party obliged to pay the compensation. Based on the provisions of Article 105.2 of the LJCA, the study carries out a critical analysis of Judgment for de Supreme
Court 267/2025 of March 11. Contrary to the Supreme Court’s doctrine, which establishes that compensation must be paid by the administration obliged to enforce the judgment on its own terms, it is held that the compensation must be paid by the entity whose judgment is annulled by the courts, without the consequences of the annulment being able to be subsequently implemented.
