Abstract

Almost fifteen years ago, Subsidies General Law 38/2003 imposed that every Spanish Public Administration could only grant subsidies through a competitive selection process. Just three exceptions were provided in order to allow Public Administrations to directly grant subsidies without following such a competitive selection process. Nevertheless, the way in which those exceptions have been interpreted and applied by Public Administrations have made direct subsidies far more common than expected. Furthermore, regional laws have created additional exceptions to avoid the competitive selection process. Th is paper delves into the issue and analyzes the lawfulness and constitutionality of those interpretations and laws.
