Abstract

The condition of water resources availability represents nowadays an element of the urban planning review of great importance. The Supreme Court maximizes its rigour in relation with its interpretation and implementation, leading to paradoxal outcomes that are not convincing in any way. An example is the November 8th, 2016 Supreme Court ruling, which abolishes Santander general urban planning. In the ruling the Supreme Courts holds a formalistic stance contrary to the public interest.
