Abstract

The effective protection of public health requires the Public Administration to show an immediate reaction to those products that may seriously endanger public health by adopting appropriate measures in order to restrain the risk promptly. Nevertheless, the implementation of these prompt preventive measures raises several problems (enabling circumstance, procedure, distribution of responsibilities for the damages infringed…) that our legislation, headed by the General Product Safety Regulation (2003), does not always manage to solve clearly.
