Abstract

Appeals will only be admitted by the European Court of Human Rights when they are made by or for the «victim of a violation» of rights recognised by the European Human Rights Convention. Examining articles 34 and 1 of that convention provides us with clues to determine who could consider themselves to be such a victim. It states that the appellant must be an individual, a group of people or an organisation with legal personality (including mercantile companies) or an organisation defending qualified interests, with special mention of «non governmental organisations». The article also discusses the situation of foreigners.
