Abstract

The law on public-sector contracts has recently been approved by parliament. This article analyses how far it has gone in applying administrative law to the activity of public-sector contracts. Specifically, it looks into the role of administrative law in regulating the bases of public contracts, an area in which the new law continues along the same lines as the previous legislation. It also considers how regulated procedures for selection of contractors have been extended at the cost of increasing the flexibility and discretionality of their application. It studies the keys to the new law, with special attention to its subjective scope of application and finally analyses the new special appeal mechanism regarding contracts.
