Abstract

Numerous studies have concentrated on the legal limits of the second generation of regional charters (Estatutos). The political debate has hardly gone beyond this focus, as if the only thing that mattered was to observe the constitutional framework, failing to recognise that this can only be an initial assumption. The constitutional legality of the regulations in these charters is one thing; the technical and political rationale of the project they represent is quite another. Equally, the defence of devolved regional powers against any kind of State-wide legislation, which can be seen in certain regions, should be kept separate from considerations of their positive or vertebrating power in the efficiency of the system as a whole, which, strictly speaking should be dealt with through a suitable reform of the Constitution. More devolution requires an improved State.
