Abstract

Infrastructure construction was traditionally regarded as a general tool of economic policy that escaped control by the European Commission. However, the way infrastructures have been managed by national governments has produced a change of approach by European Commission. Now, it seems necessary to analyze whether public investment should be subject to state aid regulation. This is due to the fact that infrastructure construction and management are economic activities performed by private entities. This paper describes this change of approach, as well as the applicable requirements and exceptions.
