Abstract

The aim of this article is to explain the doctrinal evolution of the Spanish Supreme Court regarding the designation of general managers non-civil servants, based on article 18.2 of Law 6/1997, April 14th, of Organisation and Development of the State’s General Administration, which allows this possibility. This exception has been used, at some points, exceedingly. Therefore the Supreme Court has consolidated a doctrine based on objective and concrete reasons to ensure that the designation is fit to law.
