Abstract

This paper seeks to highlight the dogmatic stagnation, but also the shortcomings
in its performance, of the disciplinary system in public employment.
It advocates a shift from the traditional, and somewhat barren considering its
results, debate on the application of the principles derived from the ius puniendi
to an inquiry into the guarantees that must be respected in the processing of these
cases, based on the incorporation of this system into the law of public organization
and employment. Based on these premises, it proposes a necessary overhaul
of the existing legal framework, both for those offenses that could be classified
as criminal according to the criteria of the ECHR, and for those that, while
not being so, require a simplification of their legal regime, without prejudice to
the minimum guarantees that those accused of such conduct should have in an
advanced state governed by the rule of law.
