Abstract

In recent years, the Supreme Court has established a favorable doctrine for a deep judicial review of the so-called «technical discretionary powers» exercised by the Civil Servants selection authorities, while respecting as a last resort the essential core of the technical judgment issued by these authorities or committees. In this judgment arises whether the result of that technical judgment can be substituted by a court decision based on the contrary opinion exposed in an expert report.
