Abstract

The author presents some constitutional rulings’ peculiarities. They are the outcome of a whole series of circumstances, particularly: the specific features of the constitutional procedure (an objective process) and, especially, the Constitutional Court’s functions in the normative system. The author finish that some effects of the unconstitutionality rulings, for example the understanding that the unconstitutional law is void ab initio and for that reason the subsequent retroactivity effect must to be understood with a relativity vision keeping out any absolutism. Coherently with this understanding, the author considers that the Constitutional Court must to assume a clear capacity of weighing and decision.
