Abstract

In this article the constitutional evolution during the Mao Tse-tung period of the People’s Republic of China is examined, until the adoption of the current constitutional text (1982). After reporting the constitutional antecedents previous to the instauration of the People’s Republic in 1949, the political institutionalisation process undertaken with the Constitution of 1954 is tackled, followed by the subsequent process of desconstitutionalization, which takes place after the cultural Revolution, and its culmination with the Constitution of 1975, ending with the process of political and constitutional transition that follows to the death of Mao Tse-tung, which is developed within the framework of the Constitution of 1978.
