The role of the public sphere in the economy: new reflections on the regulatory law

Abstract

The impact of the economic crisis has revived scientific interest in the role of regulatory law and the role played by regulators, generally independent agencies. This article offers a critical reflection on the operability of policy tools in relation to the economy, departing from the original State model of economic constitution and following an evolutionary pattern centered on the evaluation of regulatory law and its future prospects. It hypothesizes that the scenario of revision of the regulatory law must connect with parallel changes in the design and functions of regulatory agencies.
