Abstract

The current crisis of representative democracy and the emphasis on citizens’ direct participation in public affairs is taking place at a time when western societies are becoming more diverse, and plural and have a higher percentage of foreign population. This raises the question, to what extent are foreigners guaranteed access to mechanisms of direct participation in public matters. This paper sustains a substantive understanding of citizenship and political participation open to foreign population and defends that, beyond political participation strictly understood (Article 13 of the Spanish Constitution), the Spanish Constitution embraces this understanding. It then analyses to what extent the Spanish legal order conforms to it.
