Abstract

This article analyses the relationships between the European Parliament and the European Commission as they are regulated by the European Constitutional Treaty and in the political praxis, too. We pay special attention to two important cases which have happened recently. In 1999 the Commission presided by Jacques Santer resigned because of the menace of a censure motion by the Parliament («Santer case»). In 2004 the Parliament submitted the investiture of the Commission presided by Durão Barroso to the condition of accomplishing several changes in the composition of the Commission («Barroso » case). The important role played by the European Parliament nowadays makes us to reconsider the existence of a new parliamentary model in the European Union which advances more quickly than parliamentary systems in the States.
