Abstract

Act 15/2015 of 16 October 2015 has conferred new broad execution powers upon the Spanish Constitutional Court to enforce its rulings. Consequentially, an academic and public debate has arisen on the nature and scope of execution powers of constitutional courts. This article aims at analyzing the topic from a comparative perspective. To that effect, it will study the regulation and the practical experience developed in this field in Austria and Germany, with the purport of drawing useful conclusions to contextualize the new regulation on the Spanish Constitutional Court’s execution powers.
