Abstract

The Constitution of the Vth Republic is celebrating its 50th year, which is almost a record. The assessment of these 50 years of implementation presents three main characteristics; the quasi constant reinforcement of the President’s primacy (although the recent reform dated 23 July 2008 attempts to create a certain counterbalance); the relative return of the Parliament on the political scene (so that the President’s primacy consolidation occurred more at the expense of the Prime Minister than at the expense of the Parliament); the unhoped for appearance of a real constitutional justice (more particularly with the creation, by the 2008 constitutional reform, of a concrete judicial review of the laws).
